Illinois Senate Bill SB4204
Amends the Property Tax Code. Makes changes concerning certifications by the Department of Revenue for the purpose of establishing guidelines and valuations for farmland. Provides that cropland, permanent pasture, and other farmland shall be defined according to guidelines issued by the Department of Revenue (currently, U.S. Census Bureau definitions). Makes changes concerning equalization factors applied to farmland property. In provisions concerning property under a forestry management plan, provides that the Department of Natural Resources shall inform the Department of Revenue of each parcel of land covered by an approved forestry management plan, and the Department of Revenue shall notify each chief county assessment officer of each parcel of land covered by an approved forestry management plan (currently, the Department of Natural Resources notifies the Department of Revenue and each chief county assessment officer). Effective immediately.

Illinois Senate Bill SB4203
Amends the Department of Commerce and Economic Opportunity Law of the Civil Administrative Code of Illinois. In provisions concerning data center incentives, provides that, as a condition of receiving and maintaining a data center certificate of exemption, the Department of Commerce and Economic Opportunity shall require that the qualified data center operator execute and comply with a community benefit agreement with the host community in which the qualified data center is located. Provides that the community benefit agreement shall require the qualified data center operator to make annual minimum payments to the host community. Provides that the amount of the minimum host community payments may exceed but shall be at least 10% of the property tax that would have been levied against the qualified data center property, irrespective of any exemptions, abatements, or exclusions applicable to the property, for the year immediately preceding the year in which the community benefit agreement is entered into. Provides that not less than 50% of the amounts received from the special payments shall be used to provide payments, credits, rebates, or other financial benefits to eligible homestead property owners for the purpose of offsetting residential tax burdens. Effective immediately.

Amends the Use Tax Act, the Service Use Tax Act, the Service Occupation Tax Act, and the Retailers' Occupation Tax Act. Provides that, from July 1, 2026 through December 31, 2026, use and occupation taxes on motor fuel and gasohol are imposed at the rate of 1.25%. Makes corresponding changes concerning the distribution of proceeds. Effective immediately.

Amends the Medical Assistance Article of the Illinois Public Aid Code. Requires the Department of Healthcare and Family Services to seek a State Plan amendment from the Centers for Medicare and Medicaid Services regarding a prospective cost-reimbursement methodology for services provided by federally qualified health centers (FQHC) and FQHC Look-Alikes (LALs). Requires the State Plan amendment to include the following: (1) Prospective Payment System (PPS) rates for FQHCs; (2) a rate adjustment process; (3) a rate setting for new FQHCs; (4) payment in the event of Medicaid managed care; (5) payment in the event of dual enrollment in Medicare and Medicaid; and (6) appeal rights.
