Illinois House Bill HB5776
Creates the Short-Term Rental Excise Tax Act. Imposes a tax upon renters of short-term rentals at the rate of 4% of the rental price of those short-term rentals. Provides that the proceeds from the tax shall be deposited into the Community Land Trust Fund. Amends the State Finance Act to create the Community Land Trust Fund. Provides that moneys in the Community Land Trust Fund shall be used by the Illinois Housing Development Authority for development, staffing, and capacity building and technical assistance related to community land trusts in the State. Amends the Community Land Trust Home Ownership Act. Makes changes to the definition of community land trust. Effective immediately.

Creates the Illinois Epstein Files Investigation Act. Establishes the Illinois Epstein Files Investigation Commission as an investigatory and advisory commission to investigate matters related to Jeffrey Epstein's network with a nexus to Illinois, facilitate enforcement of Illinois law, and promote transparency. Grants the Commission investigatory powers, including subpoena authority enforceable in circuit court, and requires referrals to the Attorney General and periodic reports to the Attorney General, Governor, and the General Assembly. Provides victim and whistleblower protections. Authorizes the Attorney General to exercise specified authority. Directs the Attorney General to share information upon request by the Commission. Ceases operation of the Commission after 5 years and repeals the Act after 6 years. Amends the Statewide Grand Jury Act to expand jurisdiction, to include human trafficking, involuntary servitude, sexual exploitation of children, permitting and failure to report sexual abuse of a child, prostitution-related offenses, patronizing a sexually exploited child, child pornography, bribery, official misconduct, solicitation of misconduct, tampering with public records, perjury, communicating with or harassment of jurors and witnesses, money laundering, obstruction of justice, and racketeering activity, but with a requirement for Attorney General certification or a requirement that offenses occur in more than one county or have a statewide nexus. Effective immediately.

Amends the Behavior Analyst Licensing Act. Adds an occupational therapist to the individuals that the Act does not prohibit from performing or advertising activities that are considered to be the practice of applied behavior analysis under the Act. Provides that any member, partner, shareholder, director, officer, holder of any other ownership interest, or agent of a business organization that provides behavior analysis services who makes clinical decisions regarding patient care without being licensed or exempt under the Act shall be deemed to have violated the provisions concerning unlicensed practice, violation, and civil penalty. Provides that, notwithstanding any other provision of the Act and any rules adopted under the Act, a public school, school district, charter school, or nonprofit organization that is exempt or qualified for exemption from federal income taxes under Section 501(c)(3) of the Internal Revenue Code may employ or contract with a licensed behavioral analyst regardless of whether each individual who owns, operates, or manages the public school, school district, charter school, or nonprofit organization holds a currently valid license issued under the Act. Provides that a public school, school district, charter school, or nonprofit organization that is exempt or qualified for exemption from federal income taxes under Section 501(c)(3) of the Internal Revenue Code may employ, contract with, or otherwise engage a licensed behavioral analyst to perform services within his or her scope of practice if the licensed behavioral analyst holds a currently valid license under the Act. Amends the Professional Service Corporation Act. Adds the practice of applied behavior analysis by persons licensed under the Behavior Analyst Licensing Act to the list of personal services that, when combined, constitute "related professions" and "related professional services". Amends the Professional Limited Liability Company Act. Adds the practice of applied behavior analysis by persons licensed under the Behavior Analyst Licensing Act to the list of professional services that may be combined under a single professional limited liability company. Effective immediately.
