Relates to motions to vacate judgment; authorizes filing motions to vacate judgment for a conviction that was subsequently decriminalized; authorizes motions to vacate judgment to be filed at any time after entry of a judgment obtained at trial or by plea; repeals certain provisions relating thereto.
Relates to protecting the communication rights of individuals with disabilities; provides that each person with a disability has the right to communicate in their preferred manner.
Requires third-party food delivery services and third-party grocery delivery services to provide the ability to include a gratuity at the same point in the online order process when the underlying order is placed; provides that customers shall not be required to pay a gratuity; provides that third-party food delivery services and third-party grocery delivery services shall not reduce the compensation of any worker as a result of gratuities; establishes penalties for violations of such provisions.
Relates to prevailing wage requirements applicable to public works and certain construction projects performed under private contract and paid for with public funds.
Provides that an insurer doing business in this state shall be liable to a policy holder for such insurer's refusal to pay or unreasonable delay of payment to the policy holder if such refusal or delay was not substantially justified; enumerates instances whereby an insurer's refusal or delay of payment is not substantially justified including intentional negligence, failure to act in good faith, failure to provide written denial of claim, failure to make final determination of claim within six months, and failure to promptly proceed with the appraisal process.
Requires certain corporations authorized to operate in the state and subject to the supervision of the department of financial services that had annual gross revenues of at least five hundred million dollars ($500,000,000) in the prior calendar year to annually prepare a climate-related financial risk report for submission to the secretary of state and to make such report available to the public.
Requires distribution centers which are 50,000 sq. ft. or more to be equipped with electric vehicle charging stations as determined by the secretary of state and NYSERDA.
