Illinois Senate Bill SB3442

Amends the Criminal Code of 2012. Provides that a person who kills an individual without lawful justification commits first degree murder if, in performing the acts which cause the death he or she commits both aggravated driving under the influence and speeding 26 or more miles per hour over the speed limit, and such acts are the proximate cause of the death of the individual. Provides that the penalty for reckless homicide in which the defendant was operating a motor vehicle and committed aggravated driving under the influence resulting in the death of an individual is a Class 2 felony, for which a person, if sentenced to a term of imprisonment, shall be sentenced to a term of not less than 6 years and not more than 28 years. Provides that in cases involving reckless homicide in which the defendant was operating a motor vehicle at a speed 100 or more miles per hour over the maximum speed limit resulting in the death of an individual, the penalty is a Class 2 felony, for which a person, if sentenced to a term of imprisonment, shall be sentenced to a term of not less than 6 years and not more than 28 years. Provides that the penalty for aggravated battery caused by the defendant operating a motor vehicle at a speed 100 or more miles per hour over the maximum speed limit in which the defendant caused great bodily harm to an individual is a Class 2 felony for which the person shall be sentenced to a term of imprisonment of a minimum of 3 years and a maximum of 20 years. Contains a severability clause. Effective immediately.

Reinserts the provisions of the introduced bill with the following changes. Provides that the county board of a county of more than 3,000,000 inhabitants and a municipality may (instead of shall) establish an accelerated pension benefit program. Makes conforming changes. Provides that participants' elections to receive the accelerated pension benefit shall be processed and paid in the order in which the complete applications are received by the fund. Sets forth provisions concerning notifying the pension fund that the county or municipality has elected to establish an accelerated pension benefit program and remitting a contribution for the program. Provides that moneys remitted to the pension fund for the purpose of the accelerated pension benefit program must be kept in a separate account. Provides that, if any moneys remain in this account at the end of the fiscal year, the fund must remit those moneys back to the employer within one month after the end of the fiscal year, unless the employer notifies the pension fund at least one month before the end of the fiscal year that the funds shall remain in the account to be used for the subsequent fiscal year. Further amends the Illinois Pension Code. Authorizes accelerated pension benefit payments under the Chicago Teacher Article of the Code. Amends the Chicago Public Schools Article of the School Code to make conforming changes. Effective immediately.

Amends the Hospital Licensing Act. Defines "pathogens of epidemiological concern". Provides that each hospital shall develop and implement comprehensive interventions to prevent and control pathogens of epidemiological concern (instead of multidrug-resistant organisms) that take into consideration guidelines of the U.S. Centers for Disease Control and Prevention or recommendations from the Infectious Disease Society of America, the Society for Healthcare Epidemiology of America, the Association for Professionals in Infection Control and Epidemiology, or the Pediatric Infectious Disease Society for the management of multidrug-resistant organisms in health care settings. Within 12 months after the effective date of the amendatory Act, requires each hospital to adopt a policy for preventing and controlling the transmission of pathogens of epidemiological concern. Establishes reporting requirements for hospitals with patients carrying pathogens of epidemiological concern. Repeals the MRSA Screening and Reporting Act.

Provides that expenditures by a political committee for expenses related to personal security services are only exempt from provisions prohibiting certain expenditures by a political committee if the personal security services are provided by a private security contractor agency licensed under the Private Detective, Private Alarm, Private Security, Fingerprint Vendor, and Locksmith Act of 2004.

Amends the Public Utilities Act. In provisions concerning virtual power plant programs, provides that, in setting the values of upfront payment and performance payment compensation under the provisions, the Illinois Commerce Commission shall set values for eligible systems that include energy storage that are, taking into account the time value of money, not less than: (A) for an eligible system that did not receive and agrees not to apply for a rebate for its storage component under specified provisions, $250 per kilowatt-hour nameplate capacity paid on the date the system is placed in service; or (B) for an eligible system that received a rebate for its storage component under specified provisions, $0 per kilowatt-hour. Provides that, to facilitate adoption and participation, a utility must allow and enable participating customers to expeditiously share their customer information with aggregators to serve customers and comply with any reporting requirements. In provisions concerning distributed generation and storage rebates, provides that, until the later of December 31, 2029 or the threshold date (rather than until December 31, 2029), the value of specified rebates shall be $300 per kilowatt of nameplate generating capacity, measured as nominal DC power output, of the distributed generation. Amends the Counties Code. In provisions concerning setback distances for commercial wind energy facilities or commercial solar energy facilities, specifies that the ability of a county to require a reasonable setback distance between fencing and public rights-of-way if the requirement is not specific to commercial wind energy facilities or commercial solar energy facilities and does not preclude the development of commercial wind energy facilities or commercial solar energy facilities or the ability of commercial wind energy facilities or commercial solar energy facilities to comply with the requirements set forth in the provisions shall not exceed 50 feet between fencing and public rights-of-way. Amends the Illinois Power Agency Act. Provides that a "community renewable generation project" means an electric generating facility that, among other things, is limited in nameplate capacity to less than or equal to 5,000 kilowatts (rather than 10,000 kilowatts). Makes other changes.

Amends the Department of Revenue Law of the Civil Administrative Code of Illinois. Provides that, subject to appropriation, the Department of Revenue shall conduct a study to determine the living wage in the State and shall make recommendations concerning how to increase the minimum wage to ensure residents of the State earn a living wage. Provides that, no later than July 1, 2027, the Department shall submit a report containing its findings and recommendations to the Governor and the General Assembly. Repeals the provision on January 1, 2028.

Creates the Autonomous Vehicle Pilot Project Act. Provides that in order to commence an autonomous vehicle pilot project, a person must provide to the Department of Transportation a statement that sets forth the operational design domain for an autonomous vehicle pilot project. Provides that the operational design domain for an autonomous vehicle pilot project must be confined to counties having or exceeding a population of 1,000,000 individuals, as determined by the most recent federal decennial census, Sangamon County, or the counties of Madison, St. Clair, and Monroe. Allows the Department to authorize the statewide deployment of autonomous vehicles beyond the operational design domain after a period of 3 years following the effective date of the Act, as long as the Department determines the pilot projects conducted have demonstrated safety and operational readiness. Sets forth the conditions a person must meet to operate an autonomous vehicle on the public roads of the State with the automated driving system engaged. Requires a person to obtain authorization from the Department to operate an autonomous vehicle on the public roads of the State. Includes provisions regarding licensing, duties following crashes involving autonomous vehicles, registration and title, operation of a motor vehicle with an automated driving system by a human driver, vehicle equipment standards, evaluation data, the controlling authority, and home rule. Repeals the Act on January 1, 2029. Makes conforming changes to the Illinois Vehicle Code and the Consumer Fraud and Deceptive Business Practices Act. Effective immediately.

Amends the Illinois Controlled Substances Act. Provides that, if a pharmacy is unable to fill an initial prescription received electronically because the prescribed drug is not in stock, the dispenser must immediately contact the patient to notify the patient of the situation and ask if the patient would like the prescription transferred electronically to a pharmacy of the patient's choosing, consistent with federal regulations concerning the prescribing of controlled substances. Provides that the prescriber shall not be required to issue prescriptions electronically if the prescriptions need to be filled outside of typical retail pharmacy operating hours or may be difficult to obtain because of drug shortages or pharmacy inventory limitations. Amends the Pharmacy Practice Act to make conforming changes. Effective immediately.

Amends the Mental Health and Developmental Disabilities Code. In provisions concerning appeals of the Department of Human Services' determination of services charges, removes all references to the Board of Reimbursement Appeals and instead provides that appeal hearings shall be conducted in accordance with specified Department rules and provisions under the Illinois Administrative Procedure Act and that a final administrative decision is subject to judicial review. Makes conforming changes to the Sexually Violent Persons Commitment Act. Repeals the Regional Integrated Behavioral Health Networks Act and the Afterschool Youth Development Project Act. Amends the Mental Health and Developmental Disabilities Administrative Act by repealing a provision on the establishment of the Advisory Committee on Geriatric Services. Amends the Bureau for the Blind Act. In a provision concerning the Blind Services Planning Council, extends the term limits for Council members to 4 (rather than 3) years in subsequent terms after their initial term; and provides that no member shall serve more than 3 (rather than 2) terms.

Creates the Oversight and Regulation of Activity for Contracts Linked to Events (ORACLE) Act. Prohibits a prediction market platform provider from permitting any consumer under the age of 21 to register or to open any speculative position on a prediction market. Requires a prediction market platform provider to exclude certain individuals from participation in a prediction market platform. Prohibits certain types of prediction markets. Requires providers to implement and adhere to responsible gaming measures. Sets forth advertising restrictions, restrictions on credit-based products and gift certificates, and restrictions on market making. Requires prediction market platform providers to implement commercially reasonable and technically feasible measures to detect and prevent any fraud or manipulative conduct. Establishes penalties for violation of the Act. Provides that the Attorney General may adopt rules to implement and administer the Act. Contains a severability clause.

Imposes a tax on the portion of a person's annual gross revenue that is derived from digital advertising services in the State if the person's total revenue derived from digital advertising in the State exceeds $150,000,000. Provides that the tax is imposed at the rate of 10% of the annual gross revenues derived from digital advertising services in the State. Effective immediately.

Amends the Illinois Power of Attorney Act. Creates rights for patients with a health power of attorney. Provides that all individuals undergoing surgery, hospitalization, or any medical procedure shall have the right to designate a designated representative in a health care power of attorney on their behalf in the event of incapacitation. Provides that patients and their designated representatives are guaranteed the following rights: (1) the right to receive clear, comprehensive information about proposed treatments, including risks, benefits, and alternatives, in a language and format they understand, before agreeing to any procedure; (2) the right to view, request, and receive copies of all medical records, and the assurance of confidentiality in accordance with Health Insurance Portability and Accountability Act and related privacy laws; (3) the right to appeal medical decisions, including denial of treatment, discharge, or transfer; (4) the right to request and receive a second opinion from another qualified medical professional or specialist, including those outside the treating facility, without fear of delay, retaliation, or obstruction; and (5) the right to medical interpretation services for patients or their designated representative who do not speak or understand English fluently, including access to certified medical translators and translated documents, at no cost to the patient. Creates a State Patient Rights and Advocacy Commission to oversee implementation of the Act, monitor compliance by health care providers, and respond to violations. Provides that any health care provider or institution found to be in violation of the Act is subject to disciplinary sanctions, which may include: civil fines; suspension or revocation of professional licenses; facility accreditation review or suspension; and mandatory corrective action plans and staff retraining.

Amends the Notice by Publication Act. Provides that when any notice is required by law, court order, or by any contract, to be published in a newspaper, it is considered to be in compliance with the publication requirements if published in an online news media or digital news media platform as long as the media or platform serves the locale in which the notice is required to be published. "Online news media" or "digital news platform" means any website or digital platform that is regularly updated with content at least 5 days per week, has maintained this frequency of publication for no less than one year, and serves the geographic area relevant to the notice. Provides that the provision applies to all notices required to be published on or after the effective date of the amendatory Act.
