US Federal Senate Bill SB468

Introduced
2/6/25

Caption

Safety Enhancements for Communities Using Reasonable and Effective Firearm Storage Act or the SECURE Firearm Storage Act This bill establishes security requirements for the business premises of a licensed firearms importer, manufacturer, or dealer. Specifically, when the premises are closed for business, an importer, manufacturer, or dealer must secure the firearms inventory and securely store paper business records. A violator is subject to penalties—a civil fine, suspension or revocation of a license, or both a civil fine and suspension or revocation of a license.

Impact

This legislation is expected to significantly impact state laws surrounding gun ownership and commerce by enforcing stricter compliance measures for licensed firearms dealers. The increased security measures aim to protect against theft, ensuring that firearms cannot fall into the wrong hands. Moreover, the bill introduces civil penalties for noncompliance, with fines starting at $1,000 for initial violations, escalating with repeated offenses, including the possibility of license suspension or revocation. Such penalties underscore the seriousness of maintaining secure practices in the firearm industry.

Summary

Senate Bill 468, known as the 'SECURE Firearm Storage Act', proposes amendments to Title 18 of the United States Code, focusing on the security requirements for federally licensed firearms importers, manufacturers, and dealers. The bill mandates that these entities enhance the security of their firearms inventory and business records to minimize the risk of theft and improper access. It also emphasizes the proper storage of firearms when premises are closed for business, requiring the use of reinforced storage methods, such as hardened steel rods and locked storage areas.

Contention

Opponents of SB468 may argue that the legislation imposes excessive regulations on legal gun dealers, which could hinder business operations and affect the economic landscape of local communities reliant on these industries. Supporters, however, argue that the increased security measures are necessary for public safety and the prevention of firearm-related incidents. The debate revolves around balancing the need for firearm safety against the business interests of licensed dealers, and the implications of compliance burdens on smaller operations are especially contentious.
