US Federal House Bill HB7858

Introduced

Caption

Data Center Community Impact Act

Impact

The bill outlines multiple facets of data centers' impact, including their energy and water consumption, effects on air quality, land use, public health, and job creation. The study will look into how data centers contribute to local taxation, potential displacement of jobs, and whether the benefits of establishing these centers actually reach the communities hosting them. The results are expected to shed light on disparities experienced by marginalized groups, particularly in areas already impacted by environmental injustices.

Summary

House Bill 7858, known as the Data Center Community Impact Act, mandates that the Secretary of Energy conduct a comprehensive study on the impacts of data centers on communities of color and low-income populations. This bill was introduced to address rising concerns regarding the environmental and health effects of data centers, which are significant consumers of energy and water. As data centers expand, their energy consumption is projected to grow substantially, posing potential risks to vulnerable communities already facing adverse environmental impacts. The bill aims to evaluate these effects systematically and provide substantial findings to inform future policies.

Contention

Notable contention surrounding HB 7858 includes debates over how to approach the burgeoning influence of data centers in both urban and rural settings and concerns around the detrimental effects these facilities may have on local ecosystems and public health. Critics argue that without proper regulation, the expansion of data centers could exacerbate existing inequalities and negatively impact lower-income areas. Proponents contend that understanding the full implications of these facilities is key to developing effective regulations that protect vulnerable communities while still fostering technological growth.

Aviation-Impacted Communities ActThis bill increases access to noise mitigation measures for aviation-impacted communities. Under the bill, an aviation-impacted community is a community that is located not more than one mile from any point at which a commercial or cargo jet route is 3,000 feet or less above ground level. The bill expands noise mitigation program funding under the Airport Improvement Program to include aviation-impacted communities that are not currently within the 65 day-night average sound level (DNL) standard. The Federal Aviation Administration (FAA) must conduct outreach to aviation-impacted communities to inform them of the opportunity to be a designated community. A designated community must form a community board to provide information to airport operators and the FAA concerning aviation impacts (e.g., aircraft noise).A community board may petition the FAA to conduct a community assessment and, based on the assessment, the FAA must devise an action plan that alleviates or addresses the community’s concerns. In addition, the FAA must enter into an agreement with the National Academy of Sciences to conduct a study and provide the FAA with a framework and diagnostic tool for conducting community assessments. The FAA must provide grants for necessary noise mitigation in a designated community for residences, hospitals, nursing homes, adult or child day care centers, schools, and places of worship. Further, the FAA and airport operators must provide (1) noise mitigation grants for communities subject to significant frequency of overhead flights, and (2) noise mitigation for residences impacted by significant nighttime aircraft noise.
