Provides that, if a county transfers or gifts any unencumbered funds to a school corporation, the county executive may establish a local board to have oversight and manage the use of the funds. Provides that the expenses of the local board shall be paid by the county.

Preventive detention and presumptive release. Provides that a trial court may not release on bail a defendant if the state proves by clear and convincing evidence that a defendant poses a substantial risk and the proof is evident or the presumption strong. Establishes a procedure for the state to petition the trial court for a determination that a defendant poses a substantial risk. Provides that for an arrestee whose most serious pending charge is a misdemeanor or a Level 6 felony, the arrestee is presumptively entitled to release without money bail or surety. Provides that an arrestee is not presumptively entitled to release without money bail or surety if certain conditions apply.

Food and beverage taxes. Authorizes the city of Marion and the city of Richmond respectively to impose a food and beverage tax of not more than 1% of the gross retail income received from a taxable transaction. Allows the fiscal body of the town of Shipshewana to increase its food and beverage tax. Specifies that the provisions authorizing the imposition of a food and beverage tax and the increase to a food and beverage tax expire January 1, 2047. Repeals the Indiana Code chapter authorizing the imposition of food and beverage taxes in Wayne County.

Information and disclosures concerning radon. Establishes that, before signing a purchase agreement to sell or transfer residential property, an individual or entity issued a broker's real estate license by the Indiana real estate commission representing a seller shall ensure that the seller: (1) provides a radon warning statement to the buyer; (2) discloses in writing to the buyer any knowledge the seller has of radon concentrations in the dwelling; and (3) provides the buyer with a guide on radon, testing, and mitigation published by the Indiana department of health.

State educational institutions. Makes certain changes to state educational institution (institution) policies that involve: (1) disciplinary actions; (2) tenure review or promotion; and (3) student reports. Removes a prohibition on the award of admission, enrollment, employment, benefits, hiring, reappointment, promotion, or tenure on the basis of a viewpoint expressed in a pledge or statement. Repeals the following: (1) A provision concerning an employee or group of employees establishing an official institution, school, college, or department position on certain issues. (2) A provision concerning an institution's duty to report certain information to the commission for higher education (commission). (3) A provision concerning the commission's duty to report certain information to the budget committee (committee). Changes certain procedures regarding the appeal of a student report. Removes a requirement that an institution submit certain data concerning diversity, equity, and inclusion to the committee.

Annexation of fire protection district territory. Provides the following with regard to certain annexations that include property within a fire protection district (district) for which the annexation ordinance was adopted on October 7, 2024, the annexed territory does not exceed 50 acres, and the annexed territory consists of vacant land and not more than one (1) residential property: (1) The annexation is effective at least 30 days after the annexation ordinance is adopted, published, and filed with state and county officials. (Under current law, with certain exceptions, an annexation of property within a district takes effect the second January 1 after the ordinance is adopted and filed with state and county officials.) (2) Exempts the municipality from provisions requiring the municipality to: (A) commence fire protection service to the annexed territory on the ordinance's effective date; and (B) notify the district within 10 days of commencing fire protection service to the annexed territory.

Local regulation. Prohibits, subject to specified exceptions, a county, municipality, township, or neighborhood or homeowners association from adopting or enforcing an ordinance, order, regulation, resolution, policy, or similar measure that: (1) prohibits or restricts the use, sale, or lease of a motor vehicle or outdoor equipment; (2) distinguishes between motor vehicles or outdoor equipment; or (3) results in differing regulatory standards for motor vehicles or outdoor equipment; based on the fuel source that powers the motor vehicle or outdoor equipment. Requires political subdivisions located within five miles of the end of a runway of a publicly owned, public use airport to adopt an airspace overlay zoning ordinance.

Water safety curricula and drowning reporting. Requires the Indiana department of health to collect and publish certain information concerning drowning deaths in Indiana. Requires the department of education to develop curricula regarding water safety. Requires a school corporation to provide instruction on water safety as a part of the health education curriculum for students enrolled in kindergarten through grade 12.
