Establishes the insure our communities act to implement climate leadership and community protection act targets for insurers; identifies and protects such communities; relates to affordability of insurance rates; assesses covered insurance companies' record of performance at meeting insurance needs; requires covered insurance companies to file statistical reports, including information on insurance coverage in specific assessment areas and disadvantaged communities.
Establishes the New York dignity in pregnancy and childbirth act; requires hospitals and other facilities that provide perinatal care to implement an evidence-based implicit bias program for all health care providers involved in the perinatal care of patients within those facilities; requires the department of health to publish reports on maternal morbidity and pregnancy related deaths.
Establishes an economy-wide cap and invest program to support greenhouse gas emissions reductions in the state by setting a maximum allowable amount of greenhouse gas emissions by covered entities and regulating the sale or auction of greenhouse gas emissions allowances to covered entities.
Enacts the "home utility weatherization jobs act"; requires each gas corporation, electric corporation, or combination gas or electric corporation to submit to the public service commission for review and approval at least one and up to ten neighborhood scale weatherization and electrification-ready projects.
Enacts the "faith-based affordable housing act" for development on residential land; defines terms; provides that each village, town, and city shall allow the construction and occupation of residential buildings on any covered site up to the specified densities; provides that all residential buildings constructed pursuant to this section in a town, village, or city with fewer than one million inhabitants shall set aside twenty percent of the residential floor area for households earning an average of eighty percent of area median income; outlines the densities for New York city; makes related provisions.
Relates to decreasing the length of the suspension period applicable to certain individuals who lose their jobs due to a labor dispute, such as a strike, and who seek to obtain unemployment insurance benefits; decreases the suspension period from two consecutive weeks to one week; provides that the waiting period and suspension period shall be served concurrently.
Relates to the issuance of arrest warrants upon a youth who is still in high school; provides for the police officer to make a reasonable effort to notify the parent or other person legally responsible for the care of such youth or with whom the youth is domiciled that the youth has been arrested; provides that the police officer need not notify the parent or other person legally responsible when such youth is not also a juvenile offender and the notification would endanger the health and safety of such youth; amends provisions relating to sexually exploited children to include persons under the age of nineteen.
Establishes the mental health educational opportunity program and the mental health higher educational opportunity program to provide additional educational opportunities for students at certain universities and colleges in the state to enroll in academic programs that lead to a degree or degrees required for licensure in any of the mental health professions.
Establishes the NY food insecurity, farm resiliency and rural poverty initiative to provide financial assistance in the form of matching grants, hiring assistance, purchasing assistance, tax credits, tax exemptions, and reimbursements.
Relates to examinations under oath under the comprehensive motor vehicle insurance reparations act; grants claimants the right to counsel in an examination under oath; requires such examination to be transcribed; gives claimants the right to receive the transcript of such examination; prohibits insurance companies from denying first party benefits pursuant to an examination under oath until it is awarded permission to do so in arbitration.
Provides that no police officer shall arrest, restrain, or otherwise subdue a child who is thirteen years of age or less while effecting the arrest of the parent or guardian of such child; provides that all police officers present at the scene of arrest shall have an affirmative duty to keep such child safe, and shall permit the person being arrested to communicate with such child up until such person is removed from the scene.
Requires a liability insurer that has an opportunity to settle a claim at or within the policy limits, and refuses to do so, to be liable for any verdict in excess of the insurance policy limits; prohibits the insurer from recovering such excess judgment from the insured.
Directs the division of criminal justice services to study, evaluate, and make recommendations concerning instances of police brutality in the city of Rochester.
Enacts the "NYPD highway officer Anastasios Tsakos act"; requires intoxicated drivers to pay child support if such intoxicated driving results in the death of the parent or guardian of a minor child due to the influence of alcohol.
