An Act To Create New Section 25-11-126.1, Mississippi Code Of 1972, To Provide That Certain Persons Who Are Receiving A Retirement Allowance From The Public Employees' Retirement System Who Are Elected As A Member Of The Legislature After Retirement, And Certain Members Of The Legislature Who Are Eligible To Receive A Retirement Allowance From The Public Employees' Retirement System While Serving As A Member Of The Legislature, May Receive A Retirement Allowance From The System While Serving As A Member Of The Legislature; To Provide That Those Persons Shall Receive 50% Of The Amount Of The Compensation Provided For Each Regular Session And Each Extraordinary Session, Provided That The Person Serves As A Member Of The Legislature For A Period Of Time Not To Exceed One-half Of The Normal Working Days For The Position In Any Fiscal Year, Or Shall Receive Compensation For Serving As A Member Of The Legislature In An Amount Not To Exceed 25% Of The Person's Average Compensation, Without Any Limitation On The Period Of Time That The Person Serves As A Member Of The Legislature In A Fiscal Year; To Provide That Those Persons Shall Not Be Active Members Of The Retirement System Or The Supplemental Legislative Retirement Plan And Shall Not Receive Any Creditable Service For The Period During Which They Receive A Retirement Allowance While Serving As A Member Of The Legislature; To Amend Sections 25-11-105, 25-11-127, 25-11-305 And 5-1-41, Mississippi Code Of 1972, In Conformity To The Provisions Of This Act; And For Related Purposes.

An Act To Create New Sections 25-11-147 And 25-11-321, Mississippi Code Of 1972, To Provide That If A Member Of The Public Employees' Retirement System Or A Member Of The Supplemental Legislative Retirement Plan Is Convicted Of Or Enters A Plea Of Guilty Or Nolo Contendere In Any Court To A Felony In Which Public Funds Were Unlawfully Taken, Obtained Or Misappropriated In The Abuse Or Misuse Of The Person's Office Or Employment That Is Committed On Or After July 1, 2026, The Court Shall Conduct A Hearing In A Separate Civil Proceeding To Determine If All Of The Conditions Have Been Met; To Provide That If All Of The Conditions Have Been Met, The Court Shall Issue An Order That The Member's Retirement Benefits From The System Or Plan Be Suspended; To Provide That A Member Who Is Convicted Of Such A Felony Shall Not Have His Or Her Retirement Benefits From The System Or Plan Suspended Until All Appeals Of The Conviction Have Been Finally Concluded Or The Time For An Appeal From The Conviction Has Expired; To Provide That After Receiving The Suspension Order From The Court, The System Shall Request The Attorney General For A Determination Of Whether All Appeals Of The Conviction Have Been Finally Concluded Or The Time For An Appeal From The Conviction Has Expired; To Provide That After The Attorney General Notifies The System That All Appeals Of The Conviction Have Been Finally Concluded Or The Time For An Appeal From The Conviction Has Expired, The Member's Retirement Benefits From The System Or Plan Shall Be Suspended Until The Member Has Made Full Restitution Of The Public Funds That Were Unlawfully Taken, Obtained Or Misappropriated In The Abuse Or Misuse Of The Member's Office Or Employment, As Determined By The Attorney General; To Provide That If A Member Of The System Or Plan Is Also A Member Of Another Retirement System Administered By The Board Of Trustees Of The System, And The Felony For Which The Member Was Convicted Or Entered A Plea Of Guilty Or Nolo Contendere Was In Connection With The Member's Service That Is Covered By Only One Of The Retirement Systems, The Member's Retirement Benefits Will Be Suspended Only From The Retirement System In Which His Or Her Service Was Covered At The Time That He Or She Committed The Felony; To Provide That The System May Conclusively Rely On A Suspension Order From The Court And The Notice From The Attorney General That The Requirements Of This Act Have Been Met In Suspending A Member's Retirement Benefits From The System Or Plan; To Provide That The System Is Not Liable For Any Mistake In The Payment Of Retirement Benefits To A Member In Good Faith Reliance On A Suspension Order From The Court And The Notice From The Attorney General; To Provide That Any Ambiguity Or Uncertainty About Whether A Member's Retirement Benefits From The System Or Plan Should Be Suspended Shall Be Resolved In Favor Of The Member; To Amend Sections 25-11-111, 25-11-120, 25-11-129, 25-11-309 And 25-11-319, Mississippi Code Of 1972, To Conform To The Preceding Provisions; And For Related Purposes.

An Act To Amend Section 25-11-103, Mississippi Code Of 1972, To Revise The Definition Of "average Compensation" For Members In The New Tier To Mean The Average Of The Four Highest Consecutive Years Of Earned Compensation, Or Of The Last 48 Consecutive Months Of Earned Compensation, Whichever Is Greater; To Bring Forward Section 25-11-109, Mississippi Code Of 1972, For Purposes Of Amendment; To Amend Section 25-11-111, Mississippi Code Of 1972, To Provide That Members In The New Tier Who Have Completed At Least Eight Years Of Membership Service Shall Be Entitled To Receive A Retirement Allowance Upon Withdrawal From Service At The Age Of 60, And Members Who Have Completed At Least 30 Years Of Creditable Service Shall Be Entitled To Receive A Retirement Allowance Upon Withdrawal From Service Regardless Of Age; To Provide That Members In The New Tier Who Withdraw From Service Before Age 60 And Have Completed At Least Eight Years Of Membership Service And Have Not Received A Refund Of Their Contributions Shall Be Entitled To Receive A Retirement Allowance Upon Attaining The Age Of 60; To Provide That The Annual Retirement Allowance Of A Member Who Has Attained The Age Of 60 But Has Not Completed At Least 30 Years Of Creditable Service Shall Be Reduced By An Actuarial Equivalent Factor For Each Year Of Creditable Service Below 30 Years Or The Number Of Years In Age That The Member Is Below Age 65, Whichever Is Less; To Bring Forward Section 25-11-112, Mississippi Code Of 1972, For Purposes Of Amendment; To Amend Section 25-11-114, Mississippi Code Of 1972, To Conform To The Provisions Of This Act With Respect To Retirement Allowances For Death Before Retirement Or Death Or Disability In The Line Of Duty; To Bring Forward Sections 25-11-115, 25-11-117 And 25-11-147, Mississippi Code Of 1972, For Purposes Of Possible Amendments; To Amend Section 25-11-123, Mississippi Code Of 1972, In Conformity To The Proceeding Provisions; And For Related Purposes.

An Act To Create The Missing Persons Reporting And Identification Act; To Require Local Law Enforcement Agencies To Accept A Report Of A Missing Person; To Permit Local Law Enforcement Agencies To Attempt To Obtain Dna Of The Missing Person Or A Reference Sample From A Family Member's Dna To Be Submitted To The National Missing And Unidentified Persons System (namus) And The Mississippi Forensic Dna Identification System Or The National Dna Identification System; To Prohibit A Local Law Enforcement Agency From Accepting A Missing Person Report; To Require Local Law Enforcement Agencies To Accept Missing Person Reports In Person; To Provide For The Information The Local Law Enforcement Agency Shall Attempt To Gather Regarding The Missing Person's Disappearance; To Require The Local Law Enforcement Agency To Generate A Report Of The Missing Person Within The National Missing And Unidentified Persons System (namus) If The Person Identified Report Remains Missing After Five Days, But Not More Than Fifteen Days; To Define The Term "high-risk Missing Person" And The Procedures To Be Followed By Local Law Enforcement Agencies To Ensure That Those Persons Are Input In The National Missing And Unidentified Persons System (namus); To Require The Mississippi Department Of Public Safety To Establish Procedures For Determining How To Prioritize Analysis Of The Samples Relating To Missing Person Cases; To Require The Mississippi Department Of Public Safety To Immediately Notify All Local Law Enforcement Agencies Within This State And The Surrounding Region Of Information That Will Aid In The Prompt Location And Safe Return Of High-risk Missing Persons; To Bring Forward Sections 43-15-401 And 45-41-1, Mississippi Code Of 1972, For The Purpose Of Possible Amendments; And For Related Purposes.
